Welcome to BingeClub! These Terms of Use ("Terms") govern your access to and use of the BingeClub mobile application ("App"), operated by Tapebook Ltd. DBA StormingLights ("we," "us," or "our"). By downloading, installing, or using BingeClub, you agree to be bound by these Terms.
You must be at least 13 years old to use BingeClub. By using the App, you represent that you meet this age requirement. If you are under 18, you represent that your parent or legal guardian has reviewed and agrees to these Terms.
BingeClub uses Apple Sign-In for authentication. When you create an account, we may receive your name and email address (depending on your Apple ID settings). You are responsible for maintaining the security of your Apple ID and any activity that occurs under your account.
You may provide additional information such as a username, profile photo, and genre preferences. You agree to provide accurate information and not impersonate any other person or entity.
BingeClub allows you to create check-ins, share reactions ("vibes"), and post comments. You retain ownership of the content you create ("User Content"), but you grant us a worldwide, non-exclusive, royalty-free license to use, display, and distribute your User Content within the App to provide our services.

You agree to use BingeClub only for lawful purposes. You may not:
BingeClub uses The Movie Database (TMDB) API to provide movie and TV show information. TMDB content is provided "as is" and is subject to TMDB's own terms and conditions. BingeClub is not endorsed or certified by TMDB.
The App may contain links to third-party websites and services (e.g., TikTok, Instagram, X). We are not responsible for the content or practices of these external services.
Your privacy is important to us. Our collection and use of personal information is described in our Privacy Policy. By using BingeClub, you consent to the practices described therein.
BingeClub and its original content (excluding User Content), features, and functionality are owned by Tapebook Ltd. DBA StormingLights and are protected by copyright, trademark, and other intellectual property laws. The BingeClub name, logo, and "Directed by" branding are our trademarks.
Movie and TV show metadata, including posters and descriptions, are sourced from The Movie Database (TMDB). This product uses the TMDB API but is not endorsed or certified by TMDB.
We may suspend or terminate your access to BingeClub at any time, with or without cause, with or without notice. You may delete your account at any time through the Settings menu. Upon termination, your right to use the App immediately ceases.
You may request deletion of your account and associated data through the App's Settings screen. Account deletion is permanent and irreversible. To confirm deletion, you will be required to type "DELETE" as a safety measure.
BingeClub is provided on an "AS IS" and "AS AVAILABLE" basis without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, or non-infringement.
We do not guarantee that the App will be available at all times or that it will be free of errors, bugs, or interruptions.
To the maximum extent permitted by applicable law, Tapebook Ltd. DBA StormingLights shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of BingeClub, including but not limited to loss of data, profits, or goodwill.
Our total liability for any claim arising from your use of the App shall not exceed the amount you paid to us (if any) in the twelve (12) months preceding the claim.
You agree to indemnify and hold harmless Tapebook Ltd. DBA StormingLights and its officers, directors, employees, and agents from any claims, damages, losses, or expenses arising from your use of BingeClub or your violation of these Terms.
We may update these Terms from time to time. We will notify you of material changes by posting the updated Terms within the App or through other reasonable means. Your continued use of BingeClub after such changes constitutes acceptance of the revised Terms.
These Terms shall be governed by and construed in accordance with the laws of the Province of Ontario, Canada, without regard to its conflict of law provisions. Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the courts of Ontario, Canada.
